Introduction
Following a permanent exclusion, parents and carers can request an Independent Review Panel within 15 days of the Governing Body's decision to uphold the permanent exclusion. In some cases, the parent or carer can request a SEND expert to attend the Independent Review Panel. The role of the SEND expert is to:
- Provide impartial advice on whether the child's SEND needs may be relevant to the permanent exclusion
- Advise on whether the settings policies relating to SEND and the application of such policies were lawful, reasonable and procedurally fair in relation to the permanently excluded child
- Advise on whether the setting acted legally, reasonably and procedurally fair in relation to considering or identifying a child's SEND need in the case of the pupil not being recognised as having SEND by the setting
The SEND expert is impartial and therefore does not make judgements about the child's SEND need or criticise the school's policies or actions.

Please note that Clennell Education Solutions is unable to carry out this role if any of our employees have been involved in providing advice to the school in relation to the permanent exclusion or SEND advice in relation to the permanently excluded pupil or their siblings, for example, assessment and/or support of SEND.
